ORDER:- 

In the G.O. first read above, Government have framed the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010, for the State of Andhra Pradesh under the provisions of the Right of Children to Free and Compulsory Education Act, 2009 (Central Act No.35 of 2009) and published the Notification in an Extra-ordinary issue of the Andhra Pradesh Gazette, dt.5.3.2011. 

2. In the G.Os. second and third read above, Government have subsequently amended the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010. 

3. In the Lr. fourth read above, the State Project Director, A.P., Samagra Shiksha, has requested the Government for amendment of certain provisions to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010. 

4. The Government after careful examining the matter, hereby decided to amend the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010, suitably. 

5. The Director of School Education, Andhra Pradesh and the State Project Director, Samagra Shiksha, Andhra Pradesh shall take necessary further action in the matter, accordingly. 

6. The following notification will be published in an Extra -Ordinary issue of the Andhra Pradesh Gazette dated 05.10.2020.

N O T I F I C A T I O N
In exercise of the powers conferred by sub-section (1) of section 38 of the Right of Children to Free and Compulsory Education Act, 2009 (Act No.35 of 2009), the Government of Andhra Pradesh hereby makes the following amendments to the Andhra Pradesh Right of Children to Free and Compulsory Education Rules, 2010 issued in G.O.Ms.No.20, School Education (PE-Progs.I) Department, dated:03.03.2011, as subsequently amended from time to time.

AMENDMENTS
In the said Rules:-

1. wherever the words ‘School Management Committee’ occur the words ‘Parent Committee’ shall be substituted.
2. wherever the words ‘Rajiv Vidya Mission (Sarva Shiksha Abhiyan) occur the words ‘Samagra Shiksha’ shall be substituted.
3. wherever the words ‘Commissioner & Director of School Education’ occur the words ‘Commissioner/Spl. Commissioner/Director of School Education’ shall be substituted.
4. wherever the words ‘The State Council of Educational Research and Training, Hyderabad, Andhra Pradesh’ occur the words ‘The State Council of Educational Research and Training, Andhra Pradesh’ shall be substituted.

5. in rule 3, in sub –rule (1),- 

(i) for clause (5), the following shall be substituted, namely:-

     “(5). A child belonging to Weaker Sections means a child belonging to BC, Minorities and includes OCs whose parents’ income does not exceed Rs.1,20,000/- per annum in Rural areas and Rs.1,44,000/- per annum in Urban areas.”

(ii) for clause (7), the following shall be substituted, namely:-

    “(7). ‘Corporator’ means elected member of a ward of a Municipal Corporation within the limits of Andhra Pradesh.”

(iii) for clause (10), the following shall be substituted, namely:-

        “(10). ‘District Educational Officer (DEO)’ means the officer responsible for implementing the programmes for elementary & secondary education at district level.”

(iv) after clause (29), the following shall be added, namely:-

       “(30) ‘Additional Project Co-ordinator’ means the officer responsible for supporting District Educational Officer (DEO) for implementing the Elementary Education.”

6. in rule (4), after sub- rule (3), the following shall be added, namely:-

     “(4). Village Volunteers and Welfare & Education Assistant of Village Secretariat shall support the Parents Committee for identification of Out-of- School Children.”

7. in rule (9)-:

(i) in sub – rule (1), after clause (e) the following shall be added, namely:-

   “(f). AADHAAR card (g). MGNREGS Job card”

(ii) in sub – rule (4), for clause (a) and (b), the following shall be substituted, namely:- 

“(a). Disadvantaged groups:

    Orphans, HIV affected and disabled = 5%

    SC = 10%

    ST = 4%

(b). Weaker sections which includes others viz., BC, Minorities, OCs 

(whose annual income does not exceed Rs.1,20,000/- per annum in Rural areas 

and Rs.1,44,000/- per annum in Urban areas.)    = 6%

                Total =25%
